PRISONERS ESCAPED FROM BANFF

ON the Evening of Saturday last, the 19th inst. JOHN GARDEN, HUGH ROSS, and JOHN INGRAM, Prisoners in the Tolbooth of Banff, accused of different crimes, made their escape therefrom.

A description of these persons is subjoined, and the Magistrates of Banff request, that all Peace Officers, &c. will use every means in their power to apprehend these persons, and a handsome REWARD will be paid for the taking of all or any of these persons.

DESCRIPTON.

John Garden is a native of Bogfouton, in the parish of Auchterless; he is about 25 years of age, nearly six feet high, slender, but stout, and had on a Tartan Coat and Vest, (prevailing colour, green) and highland bonnet.

Hugh Ross, is a native of Ross-shire, parish of Kincardine, and worked some time at the new harbour of Peterhead. - He is aged about 24, sallow complexion, about 5 Feet 4 Inches high, and had on a light or middle blue short Coat, and blue Vest and Pantaloons - no Hat; he carried off a Bundle, containing a Blanket, &c. when he made his escape.

John Ingram, was formerly a merchant at Deskie, in Glenlivet, and is well known in Aberdeen.  He is aged about or upwards of 40 years, very sallow complexion, about 5 Feet 6 Inches high, and had on a short light gray Coat, a little ragged; grey Vest ragged; Corduroy Pantaloons, and a round Hat. - He carried off a black and red checked plaid, and a bundle containing a Blanket.

Circuit court intelligence

William Lees, convicted of theft and assault, as mentioned before, received sentence of transportation for seven years, and David Kemp, convicted of theft, was sentenced to eighteen months confinement and hard labour in Bridewell.

William Strath, cattle dealer in Boghead, parish of Fyvie, accused of theft and assault, pleaded Guilty to the indictment, and was sentenced to a year's hard labour in Bridewell, and ordained to find caution to keep the peace for two years thereafter, under a penalty of 600 merks Scots.

William Forbes was indicted for the murder of John Allan, apprentice ship carpenter, on 16th March last, by stabbing him in the side with a pen-knife, on the road leading from Aberdeen along the Spittal to Old Aberdeen.  A number of witnesses were examined for the Crown, and several in exculpation of the pannel.  The Jury found, by a plurality of voices, the libel not proven; whereupon the pannel, after a suitable admonition from Lord Pitmilly, was dismissed from the bar.

William Hay, accused of theft, was upon his own petition, consented to by the Depute Advocate, banished from Scotland for life, under the usual certification.

The last trial before the Court was that of John Garden, alias Shockey de Garden, accused of three several acts of theft, and of being habit and repute a thief.  After the evidence had been gone through on the part of the Crown, the Advocate Depute restricted the libel to an arbitrary punishment, and admitted that the charge of habit and repute had not been proven.  The Jury, after deliberating for a few minutes, returned a verdict, finding the first charge not sufficiently proven, and the Pannel Guilty of the two last; whereupon he was sentenced to be transported beyond seas for seven years.

Public roup of property in Banff

HOUSE IN BANFF.

On Saturday the 1st day of October next, at 1 o'clock afternoon, there will be sold by public roup, within the house of Mrs Anderson, vintner in Banff,

THAT TENEMENT in the BURGH of BANFF, belonging to John Garden, Shoemaker, and lying in the street leading from the Cross to the Grammar School, consisting formerly of four Vaults, and on which a Dwelling House and others were lately erected.

The articles of roup and title deeds, will be shown by John Smith, writer in Banff.
